ONC Lawyers quashed an unsafe conviction of rape for an appellant at the Court of Appeal

ONC Lawyers, acting pro bono, won a Court of Appeal (“CA”) case for an appellant convicted at trial of raping an Indonesian domestic worker. The trial judge was found to have mistakenly intervened the defence's cross-examination of the victim due to misinterpretation of the evidence rule under section 22A of the Evidence Ordinance, thereby preventing the defence from presenting its case in full. The CA held the conviction unsafe, and reiterated that “patience and gravity of hearing is an essential part of justice”.
