Miscarriage of justice corrected by the Court of Appeal in a case conducted by ONC Lawyers for an appellant sentenced to 23 years over an erroneous conviction

The appellant, Ma Ka Kin, represented by ONC Lawyers, was aged 20 at the time of the incident in 2016. He had provided his address for his friend to receive a parcel which he did not know contained cocaine. He was charged with drug trafficking along that friend. He pleaded guilty to attempted drug trafficking upon the advice of the legal team engaged by the friend’s brother in exchange for the DOJ dropping the charge against his friend. The Court of Appeal found “substantial doubt about the propriety of the conviction”, quashed the jury’s conviction without a retrial and criticized both parties’ legal teams at the trial as problematic. The appeal case was handled by our Consultant, Mr Eric Cheung.
