Government Financial Assistance on Patent Applications
The Patent Application Grant (the “Grant”) is a funding scheme set up by the government of HKSAR to assist local companies and individuals inventors to obtain patents protection for their inventions. The Grant is under supervision by the Innovation and Technology Commission (ITC) with Hong Kong Productivity Council (HKPC) as the implementation agent. The Grant aims to promote innovations and the importance of intellectual property rights and encourage local companies and inventors to make the most of their inventions through patenting.
Eligibility to Apply
Any locally incorporated companies, Hong Kong permanent residents or Hong Kong residents permitted to remain in Hong Kong for not less than 7 years that have never owned any patents in any countries or territories before are eligible to apply for the Grant. For individual applicant, the applicant must be the sole inventor or one of the joint inventors of the invention. For applicant company, the inventor(s) of the invention shall be a directly related party/parties to the applicant company, e.g. owner, shareholder, director, or staff.
Assessment of Fund Application
A preliminary assessment of the application, including obtaining report from a patent searching authority regarding the subject invention of interest, will be conducted by HKPC upon an application is received. Subsequently, ITC will make a decision on whether the application should be approved based on the assessment result.
Form of Funding
Upon approval of an application by ITC, a grant of not more than HK$150,000 or 90% of the sum of the total direct cost (whichever is lower) of the patent application will be provided, subject to administrative charges and fees.
